Issues revolved around APPORTIONMENT OF FAULT AND POTENTIAL INDEMNITY between City and property owner, as well as COMPARATIVE FAULT against plaintiff for not seeing the defect.

Plaintiff sustained internal injuries due to severe SMOKE INHALATION and CARBON MONOXIDE poisoning from smoke in his motel room where the SMOKE ALARM was missing from the room which he rented. Defendant claimed that plaintiff removed the unit himself, unbeknownst to the owner, and that the presence of an alarm would not have made a difference in the particular circumstances of the case.
