Plaintiff alleged a LEG FRACTURE from the incident, which led to additional complications due to his poor health. Plaintiff died almost a year later. The case involved both a SURVIVOR ACTION by his heir for negligence, and a WRONGFUL DEATH claim by the decedent’s HEIRS.
